Terms of Service

I’M HONOURED TO BE WORKING WITH YOU!
Please take a moment to read these Terms of Service, as they set out the terms of our relationship so that we may benefit from clear boundaries and knowing what to expect from each other. When you visit my website, use my services, or purchase my courses or workshops, you agree that you are over the age of 18 and willing to be bound by these Terms of Service. If you don’t agree, you should not continue to visit my website or purchase anything from me. These Terms of Service include Terms for 1:1 services as well as my online courses, live workshops and live group programs purchased through the New Zenler site. Working with me implies acceptance of these Terms. I reserve the right to modify the current Terms of Service at any time. Please feel free to discuss any of these Terms with me if you have any questions.  

SCHEDULING 1:1 SESSIONS OR SPEAKING ENGAGEMENTS
Sessions or speaking engagements can be booked over the phone or email. Unless otherwise agreed, our 1:1 sessions together will be conducted online or on the phone. For speaking engagements we will agree online or face to face arrangements. Please call at the agreed time of our appointment. Before we meet online, please ensure you have an up to date version of the Zoom app installed, have a stable Internet connection and are ready to go. In the event that you are not able to connect via Zoom please call me on my mobile phone.  

RESCHEDULING AND CANCELLATIONS POLICY FOR 1:1 SESSIONS OR SPEAKING ENGAGEMENTS
If you have to cancel or reschedule our appointment please do so at least 24 hours before the planned time. The full session fee will be charged when less than 24 hours notice is given or for not showing up to a session. Please see below for refunds when you purchase courses, workshops or group programs via my website.  

WHAT CAN I EXPECT IN WORKING WITH YOU? WILL I GET RESULTS?

I am qualified as a life coach, counsellor and psychotherapist with a specialist certification in food addiction counselling. Working with me may help you with unpacking limiting beliefs, becoming aware of and changing your thinking, emotional and behaviour patterns over time. Psychotherapy is usually longer-term work based on the idea that thoughts and feelings that you may not be aware of can cause challenges in your life. We work to bring unconscious thoughts, feelings and actions into your conscious mind to heal underlying deep core wounds.  

The process is not linear and there are benefits and risks. It often involves discussing unpleasant aspects of your life, and you may experience uncomfortable feelings like sadness, guilt, anger, frustration, loneliness, and helplessness. But there are also many benefits, such as  better relationships, solutions to specific concerns, and significant reductions in feelings of distress. There are no guarantees of what you will experience or how long it will take, as your needs are unique to you. To be sure to give you the best outcome possible we will continue to evaluate your needs and you can stop or pause at any time.  

MEDICAL SUPERVISION AND REFERRALS
If you have any concerns or questions about your health, please always consult with a physician or other health-care professional. I may also sometimes refer you to other healthcare professionals to deal with issues that are existing or arise during our work, or if I think that you are better served by another professional. The educational resources and courses I provide are never a substitute for medical advice.

INDEMNITY
I do not make any guarantees or warranties about the accuracy of any material displayed on my website, or the products, services, or programs offered through it, except for any non-excludable consumer guarantees and other consumer protection provisions set out in the Australian Consumer Law. I am human and errors creep in despite the best of intentions. If you see something that doesn’t seem right, please let me know. While I make all reasonable efforts to ensure that my services and programs meet with the highest standards of best practice, if something does go wrong that is not a direct result of my negligence, misrepresentation or deliberate fault, you agree that, to the fullest extent permitted by law, I will not be liable for any loss or damage arising out of or related to my website, any products or services purchased through it, or any material posted on it, irrespective of whether such damages were foreseeable, and regardless of the nature of the claim. You take full responsibility for your implementation of any suggestions that I may make while providing my services. You understand that my advice is limited to providing you with options for your consideration, and that you are solely responsible for any actions that you choose to take. Always consult your own values and vision, do your own research, and check with appropriately qualified professionals before making major decisions or making significant changes. You agree to indemnify me against all consequences arising directly or indirectly from your choices. You expressly agree that if this indemnity is unenforceable for any reason, my total cumulative liability for all causes of action of any kind (other than negligence) shall not exceed the amount that you have paid to me.  

YOUR PRIVACY
Please review my Privacy Policy to learn about how I collect and store your personal data. Please also note that in addition to my business privacy policy, which covers collection of the sensitive information referred to below, you may provide personally identifying information in connection with my website or programs which is subject to the privacy policy of New Zenler, which provides hosting for my website and my programs.

RECORD KEEPING
As part of providing services to you I have a professional obligation to securely collect and record personal information to do with name, contact details, health and wellness as well as ongoing notes documenting what happens during our sessions. I can share these notes with you upon request.

CONFIDENTIALITY
As my client you have privileged communication. This means that your relationship with me as a client, all information disclosed in our sessions, and any session notes, are confidential and may not be revealed to anyone without your written permission, except where law requires disclosure. This means that all personal information gathered during your work with me will remain confidential except when: It is subpoenaed by a court, or Failure to disclose the information would place you and/or another person at risk, or Your prior approval has been obtained in writing to discuss this information with another person. There are some situations in which I am legally obligated to take action to protect others from harm, even if I have to reveal some information about a client’s treatment. For example, if I believe that a child, elderly person or disabled person is being abused, I must file a report with the appropriate state agency. If I believe that a client is threatening serious bodily harm to another, I am required to take protective actions. I will make every effort to fully discuss it with you before taking any action. Engaging my services implies your acceptance of these terms.

EMERGENCIES
On my intake form I ask you to provide an emergency contact that you or I can contact in an emergency. If there is an emergency during our work together, in which I become concerned about your personal safety or the possibility of you injuring someone else, I will do whatever I can within the limits of the law to prevent you from injuring yourself or another.  If you have an emergency and need to contact me, please get in touch via my mobile phone or email.  

CRISIS ASSISTANCE
Please be aware that I cannot provide crisis services. If you are feeling at serious risk of harming yourself or being harmed, or have a serious mental illness, there are services that are better equipped to assist you.

RELEASE OF INFORMATION
If you ask me to, and give written consent, I may release limited information to any person/agency you specify, unless I feel that releasing information might be harmful to you. If this was the case I will explain the reasons for denying your request.

PAYMENT FOR 1:1 SESSIONS OR SPEAKING ENGAGEMENTS 
You will be issued a tax invoice and a receipt upon payment. I accept Direct Deposit in Australian Dollars to my bank account. You may also pay by PAY ID, by credit card at the end of the session, or make a secure payment through PayPal.

HEALTH FUNDS
You may be able to claim back part of my fees through your private health fund provider. Please ask me for the relevant provider number. Please also enquire with your health fund before engaging me. Counsellors are not currently reimbursable under Medicare.

PROFESSIONAL CODES OF ETHICS
I’m registered with the Australian Counselling Association. I adhere to the Australian Counselling Association Code of Ethics and the Code of Conduct for Unregistered Health Professionals.

QUALIFICATIONS
I’m a registered level 4 counsellor with the Australian Counselling Association (ACA No: 5294). For my full qualifications please refer to my website's About page.

CLINICAL SUPERVISION
I have regular supervision in order to provide you with the best possible service. Names or other identifying information are never mentioned; client identity remains anonymous and your confidentiality will be fully maintained.  

PERMISSION TO RECORD 
As part of clinical supervision I am from time to time required to record parts of or whole sessions to discuss with my supervisor. These recordings are my property and are solely used for the purpose of my supervisor assessing my competencies and skills and providing professional guidance. I will always inform you prior to recording to seek your permission and enable you to opt out. If you wish to record your sessions for your personal use, this is upon prior agreement only and strictly for your own personal use.  

DUAL RELATIONSHIPS
A dual or multiple relationship exists for a counsellor with a client when there is an additional relationship with a client apart from the therapeutic relationship. Not all dual relationships are unethical or avoidable, however dual relationships between counsellor and client can compromise the work, and for this reason will be considered from the perspective of potential harm to client or the counselling relationship.  

SIGNING UP TO COURSES, WORKSHOPS AND GROUPS
By enrolling in a course, workshop or group, you agree that you are solely responsible for your own process. The courses, workshops or groups are not intended to be a substitute for professional medical advice, diagnosis or treatment. Any content shared in the courses, workshops or groups is not intended to be used to diagnose, treat, cure, or prevent any medical conditions and is not a substitute for consulting with your personal healthcare professionals and support network. If you have any concerns or questions about your physical or mental health, you are responsible to seek out a healthcare professional outside of the scope of the courses, workshops or groups. By enrolling in a course, workshop or group, you agree to engage respectfully with other participants.

REFUNDS FOR ONLINE COURSES, LIVE ONLINE WORKSHOPS AND LIVE ONLINE GROUPS PROGRAMS YOU PURCHASE ON MY WEBSITE
For live groups or live workshops, cancellations received 30 days or more in advance of the group or live workshop will be refunded in full. Cancellations made with less than 30 days’ notice cannot be refunded, as places in the workshop are limited and there is insufficient time to offer your place to someone else.  There are no refunds for change of mind on my online courses. Due to the digital nature of the content, you receive instant access to my intellectual property. As a result it is important that you consider carefully whether a program is right for you before you make your purchase.  

ACCESS TO ONLINE COURSES 
Once you have purchased an online course on this platform, it is available for as long as I will be using the New Zenler platform unless otherwise stated. If access to the programs is likely to change, I will give you at least 30 days’ notice of the change so you can complete any unfinished programs.

DISPUTE RESOLUTION
If there is a problem, you agree to meet with me in good faith to discuss it and try to make a genuine effort to find a win-win solution. If the problem cannot be resolved within a reasonable time, you agree to pursue mediation and alternative methods of dispute resolution, with litigation being a last resort. I commit to making a similar effort to resolve any disputes in a friendly manner.  

LEGAL JURISDICTION
These Terms of Service are subject to the governing law of New South Wales. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of NSW, and the Commonwealth of Australia, will have exclusive jurisdiction.

TERMINATION OF SERVICES 
Both you and I have the right to terminate the services in writing. In the event of termination, you will be charged for the work already carried out at the date of the cancellation.

WARRANTY 
My services are provided without warranty of any kind, either expressed or implied, other than the automatic guarantees provided under Australian Consumer Law. I take my obligations under Australian Consumer Law seriously and will do my best to address any issues that arise. However, even if there is a major problem, my liability is strictly limited to:
- replacing the goods or providing the services again; or
- if I am unable to do so within a reasonable time, refunding the full amount that you have paid to me.

The content of my website and in all my programs is protected by copyright laws and treaties around the world, with all rights reserved. If you are participating in my programs, content that is available for download may be printed or downloaded to a local hard disk strictly for your personal and non-commercial use. Program content contains my trade secrets that are offered exclusively to participants. It is an essential condition of participation that you agree that you will not provide extracts of any program content to anyone else without my explicit written consent. Commercial exploitation of my content in any way that competes with my business is strictly prohibited. 

This license shall automatically terminate if you violate any of these restrictions and may be terminated by me at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any copied/downloaded materials in your possession whether in electronic or printed format.
